Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the Lensly application or website, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use Lensly.

2. What Lensly Is — and Is Not

Lensly is a discovery and communication platform only. We provide technology that allows clients to find photographers and initiate contact. That is the full extent of our service.


Lensly is NOT:

• An employer of any photographer

• A party to any agreement between clients and photographers

• Responsible for the conduct, quality, availability, or reliability of any photographer

• Responsible for the conduct or actions of any client


All photographers on Lensly are independent contractors operating their own businesses. Lensly has no control over, and makes no representations about, the quality, safety, or legality of any photography services offered through the platform.

3. Lensly Does Not Handle Payments

Lensly does not process, hold, transfer, or facilitate any payments between clients and photographers.


All financial arrangements — including pricing, deposits, final payments, refunds, and disputes — are made entirely and exclusively between the client and the photographer. Lensly is not a party to any financial transaction.


The only payments Lensly processes are optional photographer subscriptions, handled entirely by Apple via the App Store. Lensly is not responsible for any payment disputes, non-payment, fraudulent transactions, or financial losses of any kind between users.

4. Lensly Does Not Deliver Photos

Lensly does not deliver, store, edit, or transmit any photography files on behalf of users.


The delivery of photos, edited or otherwise, is entirely the responsibility of the photographer. Lensly makes no guarantees regarding the delivery, quality, or timeliness of any photography work.

5. Booking Arrangements

When a client contacts a photographer through Lensly, any resulting arrangement is a private agreement between those two parties. Lensly does not endorse, guarantee, or oversee any booking. All terms including pricing, cancellation policies, and deliverables are to be agreed upon solely between the client and photographer.

6. User Accounts

You must provide accurate and truthful information when creating an account. You are solely responsible for all activity that occurs under your account. Lensly reserves the right to suspend or terminate accounts that violate these Terms.

7. Photographer Responsibilities

Photographers are independent business owners, not employees or agents of Lensly. Photographers are solely responsible for the accuracy of their listings, delivery of services, compliance with applicable laws, obtaining proper licenses and insurance, and their own tax obligations. Lensly makes no guarantees about any photographer's qualifications, licenses, or ability to deliver services.

8. No Warranties

LENSLY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.


Lensly does not warrant that:

• The platform will be uninterrupted or error-free

• Any photographer will meet your expectations

• Any photography services booked through the platform will be performed

• The platform will be available at any particular time


You use Lensly at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LENSLY AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:


• Direct, indirect, incidental, consequential, or punitive damages

• Loss of profits, revenue, data, or goodwill

• Personal injury or property damage

• Disputes between clients and photographers

• Payment issues, refund issues, or financial losses

• Failure of a photographer to show up, perform, or deliver

• Failure of a client to pay or behave appropriately


This limitation applies regardless of the legal theory asserted and even if Lensly has been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Lensly and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the platform, your violation of these Terms, or any dispute between you and another user.

11. Photographer Subscriptions

Lensly offers optional auto-renewable subscription plans for photographers, processed entirely by Apple's App Store. Subscription pricing and terms are disclosed at the time of purchase. You may cancel at any time through your Apple ID account settings. Lensly does not offer refunds for subscription fees except as required by Apple's policies.

12. Prohibited Conduct

You agree not to: post false or misleading information, harass or threaten other users, use the platform for any unlawful purpose, attempt to circumvent the platform after making contact through it, scrape or copy data from the platform, or impersonate any person or entity.

13. Governing Law

These Terms shall be governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in New Jersey.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of Lensly after changes are posted constitutes acceptance of the updated Terms.
